These Terms and Conditions constitute a legally binding agreement between The Creative Nannies Ltd (“the Agency”) and the client (“the Client”). By engaging the Agency’s services, the Client agrees to comply with these terms.
1. Definitions
1.1 The Agency: Refers to The Creative Nannies Ltd, a nanny placement agency providing introduction services for Clients and Candidates.
1.2 The Client: Refers to any individual, family, or organisation engaging the Agency’s services to find and hire household staff.
1.3 The Candidate: Refers to the nanny or household staff introduced by the Agency to the Client.
1.4 Engagement: Includes any form of employment or engagement of a Candidate by the Client, whether on a permanent, temporary, part time, or full time basis.
1.5 Placement Fee: The fee payable by the Client to the Agency for successfully introducing and placing a Candidate.
2. Registration
2.1 Completion of Registration Form: Candidates are required to complete the online Registration Form to be accepted by the Agency unless all appropriate documents can be sent via WhatsApp/email with approval. Returning Clients do not need to resubmit the form for subsequent services.
2.2 Acceptance of Terms & Conditions: By submitting the online registration form, Clients and Candidates confirm their acceptance of these Terms and Conditions.
3. Scope of Services
3.1 The Agency provides nanny placement and other household services by sourcing, vetting, and introducing Candidates that meet the Client’s specific requirements.
3.2 The Agency conducts reference checks, identity verification, and background screenings (e.g., DBS checks in the UK).
3.3 The Agency acts solely as an introduction service. Once a Candidate is introduced, the employment relationship is exclusively between the Client and the Candidate.
4. Placement Fees and Payments
4.1 Fee Structure: Placement fees are determined by the type of engagement (permanent, temporary, or international). Fee structures are outlined on the Agency’s website at [www.thecreativenannies.com/fees].
4.2 Permanent UK Placements: Charged at 15% of the Candidate’s gross annual salary.
4.3 Temporary Placements in the UK: Charged at £100 per day or £700 per week.
4.4 International Placements: Incur a fee of 18% of the gross annual salary.
4.5 Temporary Placements worldwide: Charged at £100 per day or £700 per week.
4.6 Payment Terms: Placement fees must be paid in full at least five (5) days prior to the Candidate’s start date.
4.7 Permanent UAE Placements: Charged at 18% of the Candidate’s gross annual salary.
4.8 Temporary Placements in the UAE: Charged at 500 AED per day or 3,500 AED per week.
4.9 Non Refundable Fees: All fees are non refundable under any circumstances.
4.10 Late Payments: Subject to a charge of £100 plus 5% of the overdue amount per month. Invoices unpaid for more than 30 days may be referred to a debt collection agency, with all associated costs borne by the Client.
5. Refund and Replacement Policy
5.1 No Refunds: No refunds will be issued if the Candidate’s employment is terminated for any reason.
5.2 Replacement Guarantee: If the Candidate leaves within the probation period (12 weeks), the Agency will endeavour to provide a suitable replacement at no additional cost, subject to availability.
5.3 Conditions for Replacement: The replacement guarantee is void if:
• The Client fails to pay the fees in full and on time.
• The job description, working conditions, or location differ significantly from those originally agreed upon.
6. Client Responsibilities
6.1 Employment Contract: The Client is responsible for providing the Candidate with a written employment contract that complies with relevant employment and labour laws.
6.2 Legal Compliance: The Client must ensure compliance with all applicable laws, including those governing working hours, salary, and workplace conditions.
6.3 International Placements: For international placements, the Client agrees to cover the following costs (if applicable):
• Work visas and permits.
• Travel and relocation expenses.
• Health insurance for the Candidate.
7. Candidate Responsibilities
7.1 Professional Conduct: Candidates are expected to perform their duties professionally and in accordance with the terms of their employment contract.
7.2 Agency Liability: The Agency is not liable for the Candidate’s conduct, performance, or any disputes arising between the Client and the Candidate.
8. Confidentiality
8.1 Mutual Confidentiality: Both parties agree to maintain confidentiality regarding all information shared during the placement process, including Candidate details and Agency fees.
8.2 Data Protection: The Agency processes personal data in accordance with the UK GDPR and the Data Protection Act 2018.
9. Termination
9.1 Agency’s Right to Terminate: The Agency reserves the right to terminate services at any time if the Client breaches these terms.
9.2 Client Cancellation: If the Client cancels the agreement after the Agency has begun sourcing Candidates, a flat fee of £3,000 will apply to compensate for time and resources.
10. Liability
10.1 Introduction Service: The Agency acts solely as an introduction service and is not responsible for:
• Misconduct or negligence by the Candidate.
• Disputes between the Client and the Candidate.
• Loss, damage, or injury caused by the Candidate.
10.2 In the event of a dispute, the parties agree to attempt mediation in good faith. If mediation fails, disputes will be resolved through arbitration in England and Wales.
